1. Scope and Contracting Parties
These General Terms and Conditions (AGB) apply to all contracts concluded via the KURSEonline platform ("Platform") between Digitale Projekte RF GmbH, Franzensdorf 55, 2301 Groß-Enzersdorf, Austria ("Operator") and the users. The platform is primarily aimed at entrepreneurs (B2B), but is also open to consumers. Mandatory consumer protection provisions under Austrian law apply to consumers.
2. Definitions
Platform: The web application kurseonline.at. User: Any registered person. Course Provider: Third party offering content. Digital Content: Courses, videos, etc. Subscription Model: Recurring payment for access.
3. Registration and User Account
Paid content requires registration with truthful information. The user must keep login credentials secure. The Operator may suspend or delete accounts for violating the Terms.
4. Description of Services
The Operator provides the technical infrastructure for digital learning content. Internet access and an up-to-date browser are required.
5. Conclusion of Contract and Payment Models
The presentation of courses is not a binding offer. The contract is formed upon receipt of the order confirmation via email. For a single purchase, the user receives unlimited access over time. Subscriptions renew automatically unless canceled. Payments are processed by Stripe.
6. Prices and Payment
All prices include statutory VAT. Accepted methods: Credit Card, SEPA, Apple Pay, Google Pay. Subscriptions are billed at the beginning of each billing cycle. Invoices are sent by email.
7. Free Content
Certain content may be offered for free; the Operator reserves the right to make it paid content at any time. Already unlocked free content remains accessible.
8. Right of Withdrawal
Consumers have a 14-day right of withdrawal without giving reasons. Waiver: The right of withdrawal for digital content expires if the execution of the contract begins with the express consent of the consumer and their acknowledgment that they lose their right of withdrawal (checking a box before purchase). Refunds for valid withdrawals are made within 14 days.
9. Subscription Cancellation
Subscriptions can be canceled at any time effective at the end of the current billing period. Access ends when the paid period expires. No pro-rata refunds are given.
10. Usage Rights (License)
The user receives a simple, non-transferable right to personal use of the content. Copying, distributing, sharing login details, unauthorized downloading, or commercial use is strictly prohibited.
11. User Obligations
Users agree not to distribute illegal or offensive content, to respect third-party copyright, and not to compromise the platform's integrity.
12. Liability and Warranty
For B2B: Liability is limited to intent and gross negligence. For consumers: Statutory warranty rules apply. The Operator assumes no liability for content created by third-party course providers. Liability is capped at the purchase price paid.
13. Availability and Maintenance
The Operator strives for high availability but guarantees no uninterrupted access. No liability for force majeure.
14. Data Protection
Refer to the Privacy Policy (GDPR) for details on data processing.
15. Intellectual Property
All rights to the platform, design, and texts belong to the Operator.
16. Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Jurisdiction for B2B is Korneuburg. EU dispute resolution platform: ec.europa.eu/consumers/odr (participation is not mandatory). Changes to the Terms are communicated via email and deemed accepted if no objection is raised within 14 days.
